Nursing homes in Massachusetts can be held liable for their negligence or for causing a wrongful death. Nursing homes owe a great duty of care to their residents who may be elderly, disabled, or otherwise in need of constant monitoring and attention. Some of the various claims, which are just examples and by no means exhaustive of all potential causes for liability, for negligence or wrongful death, can be related to any of the following:
- Failing to provide basic necessities, such as food or water;
- negligent training of staff;
- failing to address medical needs (such as treatment of bedsores or dehydration) or provide medication;
Occasionally, third parties may be held liable for damages along with the nursing home. Manufacturers of defective devices, vendors who supply food, or even contractors responsible for maintaining the property or sanitizing equipment can all have potential liability in nursing home negligence cases.
